The April 2023 developments were admissible fresh evidence and were admitted; the parties agreed to set aside the Master's vacant possession order in light of those developments, but the Recorder held that, on the original merits prior to April, granting partial summary judgment for vacant possession based on the defendant owing at least HK$80,000 per month was correct. Costs were allocated: costs of the new evidence application to the Defendant; costs of the court below remain as originally ordered to the Plaintiff; costs of the appeal to the Plaintiff.
