The court granted exceptions under s.106 of the Regulation for the publications listed in Schedule 1 and Schedule 2 because the non-compliances were caused by inadvertence and reasonable excuse, there was no bad faith, prompt remedial action was taken and full disclosure was made; s.34 of ECICO did not apply and the third relief was unnecessary and refused.

Because the applicant was a charitable group with no connection as candidate or agent, the field of election law is obscure to ordinary people, the contravention was inadvertent without bad faith, and the applicant promptly sought to rectify matters, it was just to exercise the s31(2) discretion to relieve the applicant from penalties and disqualifications.

The court found the leaflet non-compliance with s.34(1) was inadvertent and not in bad faith and therefore exercised its discretion under s.35(2) to except the publication from s.34 requirements and relieve the applicant from penalties.
