Because a Notice of Opposition and an affirmation opposing the winding-up petition were on the court record and were not withdrawn, Master Chung lacked jurisdiction under s.180A(1) to entertain the petition; orders made without jurisdiction are nullities and must be set aside; consequential orders by another Master were also unsustainable; costs are to be borne by the petitioning company and taxed on a common fund basis; the petition may be remitted to the companies judge where permissible.
