Given clear dereliction of duties by the 1st defendant, evidence of misappropriation and genuine concern that she will not properly represent the estate in ongoing litigation, the court removed the 1st defendant as administrator, appointed the plaintiff as substitute administrator and made a vesting order in favour of the plaintiff to secure proper accounting and administration of the estate assets; appointment of a professional administrator was unnecessary given the estate's size and composition.
