Because a material piece of documentary evidence (the wedding guest list) that could have materially supported the defence was not put before the trial court due to a mistaken view by defence counsel, combined with inconsistencies in prosecution evidence and doubts about the Magistrate's scrutiny of credibility, the conviction was unsafe; appeal allowed and a new trial ordered.
