Insufficient evidence existed to show the re-delivery to Mr Lee was induced by fraud and there was no agency relationship or intention showing Mr Lee acted as the Plaintiff's agent; consequently the Defendant voluntarily surrendered possession and lost its repairer's lien and is liable for conversion. Plaintiff is entitled to delivery of the Car or payment of its value and damages for loss of enjoyment.
