On the balance of probabilities the defendant signed and received the loan and made the three deposits evidenced by the plaintiff's contemporaneous computer Printout, bank passbook entries and invoices from debt collectors; those deposits were payments in respect of the loan under s23(3) Limitation Ordinance and thereby restarted the limitation period so the claim was not time‑barred; judgment was entered for the plaintiff for principal and interest and costs.
