The plaintiff and his tenant were in exclusive factual possession and had the requisite animus possidendi for over 12 years, constituting adverse possession which, by section 17 of the Limitation Ordinance Cap.347, extinguished the Deceased's estate's title; accordingly the plaintiff acquired an indefeasible possessory title.
