    Court
    Court of First Instance
    Case number
    HCMP2316/2013

The defendant failed to make good title to the plaintiff by ignoring and inadequately answering reasonable requisitions for over five months, merely adopting the head vendor's responses without independent inquiry; therefore the plaintiff validly repudiated the contract and is entitled to return of deposits and consequential losses with costs, while the defendant, having accepted the head vendor's title by adoption, forfeited its deposits to the third party and its claims against the third party are dismissed.
