The court directed that expert evidence be confined to the narrowly identified Expert Issues (Issue 3 and Variation Orders 5, 13 and 14), that the assessor be appointed only to assist the court (not to produce an evidential report), and that the assessor be supplied with the final revised joint report, relevant witness statements and skeleton submissions but should focus only on the Expert Issues; joint experts must explain reasons and properly engage in joint reports and the parties must comply with duties under Order 1A and Order 38 rule 35A.
