The cockloft extension was an unauthorized structural alteration rendering the vendor unable to show good title, but the purchaser (Large Land) was at all material times aware of the illegality and by conduct (including use of an addendum, failure to requisition in time and reselling before raising the issue) unequivocally elected to affirm the contract and thereby waived objections; purchaser's subsequent failure to complete entitled vendor to forfeit deposits under clause 20, so purchaser's claim for repayment fails.
