The Court of Appeal allowed the appeal because as at the completion date (16-18 March 1998) the defendants had not shown good title: they failed to disclose the 1st purchaser's prior provisional agreement and related litigation, the requisitions were therefore timely, and the outstanding claim and pending registration meant the 2nd purchaser faced a real risk of a successful assertion against title; accordingly the 2nd purchaser was entitled to relief including refund of the deposit with interest and further assessment of damages.
