The applicant’s second ex parte application for leave was an abuse of process because he failed to disclose a prior unsuccessful application, breaching the duty of full and frank disclosure, and there was no arguable basis for re-litigation; accordingly the Notice of Appeal was strike out and the appeal dismissed.

Section 14AB of the High Court Ordinance precludes an appeal from this Court's decision on whether leave to appeal should be granted, and the applicant failed to challenge the Court's finding of abuse of process; therefore the application for leave to appeal to the Court of Final Appeal is dismissed.

Leave to appeal was refused because the plaintiff failed to show any arguable ground of appeal: the claim is an abuse and a re-run of earlier litigation and in substance a claim for loss of income requiring trustee consent; no novel point of law or binding authority was overlooked that would warrant the Court of Appeal's intervention.

The Vice‑President exercised his discretion to refuse the adjournment: potential common issues with other proceedings and an earlier vacated date did not justify delaying the appeal scheduled for 30 October 2009; one related matter was at a preliminary stage and the other set for February 2010, making postponement speculative and likely to cause undue delay; the Small Claims were struck out as re‑litigation and trimming of the bundle did not amount to a sufficient reason to adjourn because points barred by the case stated procedure could only be pursued with the court's leave.
