The application was dismissed because there was no final judgment against the Hotel when Ming An sought post-judgment interest; the court would not exercise its discretion under s48(3) High Court Ordinance to backdate interest solely to enable Ming An's claim; Ming An elected the wrong procedural remedy by pursuing post-judgment interest rather than a restitution claim and therefore cannot recover the interest sums as assignee since it cannot obtain more than the assignors would have obtained.
