The plaintiff's Order 52 r.2(2) statement was fundamentally defective because it failed to state personal service of the Restraint Order or give a valid reason for non‑service; that defect required setting aside the leave to commence committal proceedings and dismissal of the originating summons. Alternatively, even on the merits the plaintiff failed to prove beyond reasonable doubt that the defendant caused or authorised the Taiwan hearings; accordingly committal was not established.
