The Retirement Fund, being paid by the scheme administrator and not by the employer, did not fall within the consent order's definition of 'severance payments' and the Respondent was not in breach; however, the court must preserve family assets and protect the children's needs, so the interim injunction was varied to require deposit of a specified sum into escrow and permit a limited release ($132,000) for legal costs and children's educational/insurance needs while restraining further disposal of the balance.
