The pleadings in HCA347/2013 and HCA432/2013 disclosed no reasonable cause of action and, taken with the plaintiff's history of identical unsuccessful proceedings and the binding effect of the Development Agreement and prior court decisions, were frivolous, vexatious and an abuse of process; accordingly both statements of claim were struck out, the actions dismissed, and restrictive orders (RAO/RPO) were imposed to prevent further vexatious litigation, with indemnity costs to defendants.
