The Court held that the statutory and common-law requirements for recognition and assistance were met: the BVI insolvency was a collective proceeding and, although in the place of incorporation, limited managerial and practical assistance was appropriate. The relief sought mirrored the standard-form recognition order, was consistent with BVI powers, necessary to realise assets in Hong Kong and did not offend Hong Kong law or public policy; accordingly the originating summons was granted and the requested powers conferred.
