Material inconsistencies between the magistrate's oral and written reasons—particularly on the role attributed to the appellant's blood alcohol and on the assessment of speed—undermined the safety of the convictions; accordingly convictions were quashed and retrial ordered in the public interest.

The appeal was allowed because the charge omitted the material statutory allegation that the false statement was made pursuant to the Immigration Ordinance or a requirement made thereunder; that omission was fatal to the conviction and justified quashing the conviction and ordering a retrial.
