The Court held the applicant did not meet the seven‑year continuous ordinary residence requirement because her residence was broken by the absence from 27 January to 4 June 1992 and periods employed as a foreign domestic helper must be excluded under s2(4)(a)(iv) whether before or after 1 July 1997; the late constitutional challenge to s2(4)(a)(iv) was not permitted and the Director owed no duty to advise in the circumstances, therefore the appeal is dismissed.
