On the evidence the seized documents were written instructions prepared for and in the course of obtaining legal advice and therefore attract legal professional privilege; there was no evidence of an express or implied intention by the applicant or his solicitors to waive that privilege and, applying the principle that waiver will not lightly be inferred, the ICAC must return the documents.
