The court held that the vendor was estopped from denying that title free from encumbrances passed by the 1946 assignment, the 1947 reassignment to the mortgagor fed that estoppel, the power of attorney had not been revoked at the time of its exercise, and therefore the plaintiff had a marketable title which the purchaser was obliged to accept.
