On a balance of probabilities the court found multiple items of the Family Debts were not established or legally enforceable and that, when those disallowed claims are excluded, the votes in favour of the IVA would have fallen from 79.38% to 65.53% (below the 75% threshold); this constituted a material irregularity under s.20J BO such that the creditors' approval was revoked; Zhongcai's r.122Q appeal out of time was dismissed.
