The conviction for manufacturing was unsafe because the prosecution failed to prove the appellant was 'found' in the premises at the same time as the manufacturing equipment so the section 45 presumption could not be invoked; however the conviction for possession was safe because the evidence (keys, possession, appellant's statements and quantities found) supported the section 47 presumptions and the trial judge's interventions and the Crown's reply were not so prejudicial as to render that conviction unsafe.
