The Court granted leave to appeal to the Court of Final Appeal on Questions 1, 2, 3, 4(a) and 4(c), holding those questions raise issues of great general or public importance touching the interplay between Article 3 and Article 14 HKBOR and the proportionality assessment of the Policy; the Court refused leave on Question 4(b) as not reasonably arguable, explaining that adopting a criterion that "leaves no room for ambiguity" was consistent with applying a "no more than necessary" proportionality scrutiny and did not amount to a less stringent threshold.
