The summons for an extension of time to appeal was dismissed because the plaintiff offered no acceptable explanation for delay and the proposed appeal had no real prospect of success: the impugned statements were not made by the defendants, the court Order is absolutely privileged and cannot ground defamation, the claims were frivolous/vexatious and an abuse of process (res judicata), and the judge below was correct to strike out and dismiss the action.

Additionally, Mr Kennedy had no right to represent other liquidators before the master and those matters were irregular and adjourned sine die.
