The appeal is dismissed because the applicant failed to demonstrate that the Judge erred in law or that the Board's decision on the BOR 2 risk was unlawful, procedurally unfair or Wednesbury unreasonable; bare, unsupported assertions and failure to supply further information after invitation cannot sustain an appeal for leave to apply for judicial review.

The judge did not err in refusing leave because the applicant's proposed grounds were bare assertions unsupported by evidence, raised factual issues for the Board rather than public law errors, and therefore disclosed no reasonable prospect of success; the Court of Appeal dismissed the appeal for lack of viable grounds to reverse the judge.
