The Court held that the magistrate did not err in law in selecting a 15-month starting point based on the heroin quantity, lawfully increased the sentence by 12 months for aggravating factors including prior convictions and risk of distribution, and appropriately reduced to 18 months immediate imprisonment in light of the guilty plea and other considerations; the appeal against sentence was therefore dismissed.
