The Registrar breached procedural fairness by applying a materially different legal framework (the T-Mobil approach) after the hearing without informing the parties or giving them an opportunity to make fresh representations about the changed legal principles; accordingly the decision of 12 June 2000 declining extensions of time was quashed and the matter remitted for reconsideration in accordance with law.
