The judge concluded that a claim under S.60 alleging dispositions made with intent to defraud creditors is an action 'based upon an allegation of fraud' within the meaning of O.14 r.1(2)(b) in Hong Kong and therefore not amenable to summary judgment; accordingly the O.14 application was dismissed and the defendants were permitted to defend (leave to defend granted).
