Regulation 38B imposes strict liability on the contractor to provide and keep scaffolding or other means of support at the immediate place where work cannot safely be done; movable frames elsewhere on site do not discharge that duty and the Magistrate's factual finding that no proper support was in position at the work location was correct, thus upholding the conviction.
