The Tribunal held that the ad hoc resolution to fix the number of committee members at nine was ancillary or incidental to the resolution in the AGM notice to elect and appoint a new management committee; applying the objective common-law test of fair notice and the purpose of the AGM, the omission of a specific number in the notice did not render the ad hoc resolution invalid or unfair to absent owners. Consequently the ad hoc resolution and the election and appointment resolutions were valid; the applicant's claim was dismissed.
