Given the totality of circumstances — appellant found in the lavatory appearing to destroy papers, possession of 18 calculation sheets consistent with bookmaker records, possession of keys to the premises, presence of equipment and race broadcast — the magistrate was entitled to infer the appellant was engaged in bookmaking and to convict him under s.7(1)(a) of the Gambling Ordinance; mere presence was not the factual finding here.
