On the balance of probabilities the wife lacked means to meet ongoing legal costs, produced credible evidence of outstanding prior bills and limited income, while the husband had access to substantial family funds and the ability to obtain loans; applying the statutory power in s.3 MPPO and the Currey guidance, the court found it reasonable and fair to order the respondent to pay HK$58,000 per month from 12 April 2013 for the wife’s legal costs for the custody application, subject to payment to solicitors and review at trial.
