The Court held that the trial commissioner's factual findings that the third plaintiff was not contributorily negligent on driving issues were unimpeachable and that, on the law, failure to wear an available seat belt is a failure of ordinary prudence in Hong Kong and therefore amounted to contributory negligence; damages for the first plaintiff were reduced by 20% in respect of that part of the injuries and consequences that would have been prevented by a seat belt (applying Froom v Butcher).
