The court held that the case was indistinguishable from H v Director of Immigration and that Section 14AB applied, rendering the decision of 10 May 2019 final; consequently the Notice of Motion and Inter Partes Summons were dismissed and the applicants must seek leave from the Appeal Committee.

Section 14AB of the High Court Ordinance precludes an appeal from a Court of Appeal decision on whether leave to appeal under s14AA should be granted; therefore the applicant's notice of motion seeking leave to appeal to the Court of Final Appeal was impermissible and was dismissed.

The motion for leave to appeal to the Court of Final Appeal was dismissed because the plaintiffs failed to advance substantive constitutional arguments at the original leave application, China International Fund remains binding and not plainly wrong, and Section 14AB prevents a further appeal from the Court of Appeal's final refusal of leave; therefore leave to appeal to the Court of Final Appeal is refused.
