On a true construction of ss.16 and 17 read together, the Board's 17 December 2010 decision about whether submissions made pursuant to planning conditions satisfied the conditions was not a "decision of the Board under section 16" within the meaning of s.17(1); consequently the Board had no power to review that decision under s.17 and the Appeal Board's contrary decision was legally erroneous and is quashed.
