Leave under section 168BC was refused because it was not prima facie in the interest of Wealthy Vantage and Golden Field: their defence would be identical to that of Mr Tang/Mr Kwan, Mr Kwan could protect their interests without incurring additional legal costs, and Kaiser’s undertaking not to enter judgment against the companies until conclusion of related trials meant they would suffer no real prejudice from refusal.
