The court declined to award costs under s.17 because the respondents' reliance on s.4 CCCO and the authority Lee Ming Tee, which had not been expressly overruled at the time, could not be characterized as conduct 'without reasonable cause' or such that no reasonably well informed and competent legal professional would have undertaken; consequently the appellant failed to prove an unnecessary or improper act causing the costs and no order as to costs was made.
