The Court held that the respondent was a constituent offender whose targeted filming constituted prohibited conduct under section 18(1) POO, and that the respondent had the requisite participatory intent to become part of the assembly and to engage in the prohibited act; the CFI misapplied HKSAR v Lo Kin Man by failing to draw an irresistible inference, so the appeal was allowed and the conviction and sentence restored.
