Clause 19 was ambiguous and did not plainly shift the risk of unauthorised building works to the purchaser; Grandfix failed to demonstrate a bona fide defence or triable issue on the unauthorised works ground, All Ports validly accepted repudiation and sought return of deposits, and therefore the Master was correct to grant summary judgment on that ground; although the section 26 issue could require trial, it did not prevent summary judgment on the unauthorised works issue.
