The court accepted that the plaintiffs' date of knowledge of the defendant was 26/4/74 (based on police particulars obtained following the legal aid application) and that the writ issued within three years of that date; accordingly the action was not statute-barred. The court further held that even if an earlier date had been found it would in any event exercise its discretion under s30 to allow the action to proceed on the facts presented.
