The magistrate erred in admitting and relying on previous convictions under section 29(3)(b) because the accused was being proceeded against on an alternative charge of theft (thus the subsection did not apply), and the magistrate wrongly treated evidence admitted under the subsection as giving rise to a presumption of guilty knowledge; accordingly the conviction on the handling charge was quashed.
