Given the prior reasons for detention remained valid and the practical expectation that the respondents would give evidence in the near future, and absent full argument on proposed alternatives to detention, the court was bound to grant a further limited detention order until 26 November 1993 while preserving liberty to apply for extensions and requiring the Attorney General to file evidence for any further application.

Judge held that, on assumed favourable test to respondents, there was a reasonable prospect witnesses would give evidence within a reasonable time (assessed as by end of December) and the public interest in completing a major criminal trial outweighed respondents' liberty interests; accordingly orders for further detention for up to 21 days from 8 October 1993 under s32(4)(b) were lawful and granted.
