Appeal dismissed: the court upheld the judge's order permitting examination under s221. Section 33(1) Theft Ordinance prevents answers being admissible in theft prosecutions thereby removing the principal risk of self-incrimination as to existing theft charges; for other hypothetical incrimination risks the Evidence Ordinance s65 provides adequate protection and there was no factual basis shown for a reasonable apprehension of incrimination beyond speculation.
