Applying the Order 14 test and s40E Cap.341 the court found no real triable issues: the defendant's defences were weak, the defendant had waived or should have raised capacity/jurisdiction objections in the PRC proceedings, the award did not exceed the arbitration scope, and the public policy threshold was not met; accordingly the court exercised its discretion to enter summary judgment enforcing the PRC award as a debt for the Hong Kong dollar equivalent of RMB191,189.85 and awarded interest and costs nisi.
