The plaintiff failed to satisfy the jurisdictional and necessity requirements for pre-action discovery: she already possessed sufficient particulars to formulate misrepresentation claims in respect of the ELNs and the loan, failed to show how the documents sought were necessary to plead or commence proceedings, and did not establish a viable misrepresentation claim as to the forex transactions; accordingly the court refused the pre-action discovery application and ordered costs for the defendant.
