On the balance of probabilities the contemporaneous evidence and conduct showed the defendant retained the title deeds since June 2013; accordingly the court granted the plaintiff's re-amended relief: a declaration that the Property is not encumbered by any equitable interest created by deposit of title deeds except the plaintiff's mortgage, a mandatory injunction requiring the defendant to deliver up the title deeds or, if unable, to execute the proposed statutory declaration, and ordered costs to the plaintiff on a nisi basis.
