The court held that attendance by counsel on 18 October and the adjournment made by Mr. Rogers (acting magistrate) satisfied the requirements of s.104(1)-(2) when read with s.54 Interpretation Ordinance, thereby vesting Mr. Duffus with power under s.104(4) to hear the review; accordingly mandamus was appropriate to compel him to hear and determine the review.
