The US$250,000 paid into Court in May 2007 was not a secured continuing periodical payments order but a lump sum to be drawn down over an anticipated period contingent on the wife's residence in Hong Kong; the wife's undertaking not to apply until April 2010 is discharged, the appropriate effective date for fresh orders is September 2009, the father must pay a lump sum equivalent to school fees from Sept 2009 to date (to be calculated and evidenced) and is responsible for ongoing school fees; the charging order nisi remains in effect pending further argument and costs are reserved.
